Part C Eligibility Criteria

The Individuals with Disabilities Education Act (IDEA) requires that all States define which infants and toddlers are eligible to receive services under the IDEA program for infants and toddlers (Part C). An eligible infant or toddler must either have a developmental delay or a diagnosed physical or mental condition with a high probability of resulting in developmental delays. Each State establishes the criteria for the extent of the developmental delay and may identify the established conditions that make a child eligible for services.
